The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "Client", "You" and "Your" refers to you, the person log on this website and compliant to the Company’s terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to Saanjh-DILASA Portal. "Party", "Parties", or "Us", refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of INDIA. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

Your use of the website and the portal is at your sole risk, which is provided on an “as is” and “as available” basis. We and our licensors expressly disclaim all warranties of any kind, whether express or implied. We do not guarantee the accuracy, completeness, justness, fairness, neutrality, validity or usefulness of the services, any award or settlement made by any dispute resolution professionals, any other service or content provided by Jupitice, and you rely on the services, the dispute resolution professionals allocated for an active dispute and other service or content of Jupitice at your own risk. Any material that you access or obtain through our services is done at your own discretion and risk and you will be solely responsible for any damage to your computer or loss of data that results from the download of any material through our services.

To the maximum extent permitted by applicable law, we and our licensors will not be liable for any direct, indirect, incidental, special, consequential, or exemplary losses or damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if we have been advised of the possibility of these damages), resulting from your use of the services, the portal or the services of the dispute resolution professionals allocated to your dispute. Under no circumstances will the total liability of Saanjh-DILASA and our licensors of any kind arising out of or related to your use of the services (including but not limited to warranty claims), regardless of the forum and regardless of whether any action or claim is based on contract, tort, or otherwise, exceed the amounts, if any, that you have paid to us for your use of the services in relation to the active dispute to which such losses or damages relate.

PAYMENT TERMS:

I/We agree to pay the charges for Products and Services as stipulated by Saanjh-DILASA and understand that such charges for Products and Services are exclusive of applicable taxes & levies (if any), and we agree to pay such additional amounts as may be taxes and levies.

REFUND:

Only for the following reason and any other reasons decided by Saanjh-DILASA at its sole discretion, Saanjh-DILASA shall refund the payments made by me/us, in its sole discretion, from time to time:

• The Complainant (user) has provided the consent for mediation and made the payment but the defendant (other party) refused to pay his/her fees to Saanjh-DILASA after providing consent for mediation process or refused to take part in the mediation process. In such case, the refund shall be initiated upon request made by the user at our helpline number: 1800-309-8666

MISCELLANEOUS

These Terms and Conditions and any access to or use of the Website or the Portal will be governed by the laws of the Republic of India, including its conflict of law provisions. Any dispute arising under these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts at Chandigarh, India.
